Terms & Conditions for Waiting Lists

1. We will keep your information on our waiting list for no longer than 1.5 years unless you explicitly ask for your information to be kept longer

2. We will not inform you that your data has been removed from our waiting list and that the information has been disposed of correctly after the period of 1.5 years (without purchasing a puppy)

3. Your data will automatically be removed from our waiting lists once you purchase a puppy (and your information will join our puppy families information).

4. No payment is made for joining our waiting lists

5. No refund is made (by us to you) for removal of information

Terms & Conditions for Puppy Visiting Sessions (both meeting & training sessions)

1. Puppy Visiting Sessions include both sessions to meet puppies, and also training sessions with your future puppy (before puppy is old enough to leave Mum & litter)

2. Puppy visiting sessions are by pre-arrangement and by invitation only. Please do not come to my home requesting to see puppies without being invited and us arranging & agreeing a suitable time beforehand

3. Elemental Cavaliers reserves the right to vary or cancel a puppy visiting session, and can accept no liability if, for whatever reason a puppy visiting session does not happen

4. If you need to vary or cancel a puppy visiting session, you do so at your own expense. Since the training sessions only take place on specific dates, it may not be possible to arrange an alternative

5. Only the invited individual(s) may attend puppy visiting sessions. You may not send an alternative person to attend. These are for bonding with puppies as well as learning

6. If there is a legal reason why puppy visiting sessions cannot go ahead, we will need to arrange something else in their place. Obviously this is not ideal so we hope this is not the case (thinking about events of the past few years)

7. Puppy visiting sessions are for a fixed period of time to ensure all families are given sufficient time – so please arrive & plan for your agreed time for fairness

Terms & Conditions for Payments

1. Payment is required in full (ie the overall total cost) before a puppy can leave

2. Only when the complete balance payment is made in full is when a purchaser ‘puppy family’ is considered the new owner. Until that time the puppy does not belong to that individual (or group)

3. Part-payment does not give any legal ownership over a puppy

4. The contract between us – We must receive payment in full (of the whole of the price) for the puppy before your payment can be accepted. Payment of the price for the puppy represents an offer on your part to purchase the puppy, which will be accepted by us only when the puppy leaves to go to your home. Only at this point is a legally binding contract created between us

5. All payments re made through BACs online bank transfer

6. Our bank details will be given to all those on our waiting lists and again at the time to those people wishing to reserve puppies

7. All transactions will receive emailed receipts for your records

8. To secure your puppy: 10% of the total charge is payable – this is non-refundable

9. Once the puppy contract has been signed (and before collection of puppy) the balance for the total cost must be paid. You will be made aware of the payment date for your puppy litter and in contact with us through the entire process

Terms & Conditions for Reserving a Puppy

1. Use the Bank Details Provided: Once you have talked with us and decided which puppy you would like to reserve, use the bank details provided by us to make a BACs online transfer non-refundable payment of 10% of the total cost. This payment is the Puppy Reservation Fee Payment

2. To Confirm Reservation of Puppy: This Puppy Reservation Fee (the non-refundable 10% of the total puppy cost) must be received into our bank account for us to confirm the reservation of the puppy. (By all means email, text or telephone us so we can keep each other updated at this time about payments so we can keep checking)

3. Confirmation of Reservation: Puppy reservation confirmations are via email (along with a receipt of the amount paid)

4. This payment is for reserving a puppy only: Until the full balance has been paid (of the total puppy cost), the ownership of the puppy is ours and we consider them our babies until that point. When the full balance is paid, at that point then they become your baby puppy

5. If there is a significant delay in receiving a Puppy Reservation Fee from someone: Elemental Cavaliers reserves the right to enable another person to reserve the puppy you wanted. Unfortunately, there are limited numbers of puppies and whilst we can allow a reasonable amount of time for payments to clear, we are unable to hold the puppy indefinitely

6. The Puppy Reservation Payment goes towards the Overall Total Cost: The 10% non-refundable puppy reservation fee is deducted from the overall cost of the puppy (meaning 10% has already been paid when it comes to the paying the remainder of the cost). This is the case providing that you commit to the total cost, pay the overall total cost and take ownership of the puppy. If you pull out from buying the puppy after paying the Puppy Reservation Fee, the 10% is non-refundable and acts as our cost for admin and marketing

7. If there is an extreme case (luckily we have not ever encountered this situation before) whereby, on receiving your reservation payment, if Elemental Cavaliers becomes aware of new inappropriate information and concludes you are no longer a suitable choice for one of our puppies, we reserve the right (as caring and ethical breeders) to remove your details from our reservation list. In that situation we would refund your reservation payment to you in full

Ownership of rights

All rights, including copyright, in this website are owned by or licensed to Elemental Cavaliers. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.

Accuracy of content

We have taken care in the preparation of the content of this website. However, if there are material errors in the description or content within this website, we will update and amend it when we are shown any errors.
